It’s been more than a year since REBA Title Standard No. 68 was updated in part to clarify and expand the ways to establish trustees of record for the purpose of relying on a Certificate under MGL c. 184, § 35. This discussion will look at the different ways to meet the requirements of the standard to establish trustees who weren’t named in a recorded Deed, particularly successor trustees and devisee trustees.
