Withholding on Sales of Massachusetts Real Estate

Beginning November 1, 2025, new tax withholding regulations affecting transfers of Massachusetts real estate with a gross sales price equal to or exceeding $1,000,000.00 will take effect. In connection with such sales, real estate conveyancers will be responsible for obtaining certain information from transferors and filing specific forms with the Department of Revenue after closing. In cases where a withholding is required, conveyancers will also be required to collect and remit those funds to the Commonwealth. Please join for an overview of the regulations and new forms, the implications on the industry, and how to best prepare for and handle these transactions moving forward. To see the final regulations (830 CMR 62B.2.4), click here.
